FCA Test Case Update

“Further to our previous communications we can confirm that MS Amlin along with the FCA, six insurers and an action group have been granted permission to appeal the judgment issued by the High Court in September to the Supreme Court.

This case will be heard in the Supreme Court from the 16th of November and is likely to take 4 days. It is anticipated that the final judgment on the test case will be made this year.

We have written to clients who have made claims informing them of this and reiterated that until there is clarity on the situation, which we hope will be provided by the Supreme Court’s judgment, we are unable to conclude their individual claims.

However in order to enable the prompt adjusting of claims once the judgment has been delivered MS Amlin has been writing to claimants asking for the information needed to process their individual claims. We would encourage all claimants to respond to this request.

With regards to the most recent lockdown starting on the 5th of November, clients who believe they have a claim should follow the normal claims process and we will consider each claim on a case by case basis.

We will write to clients again once judgment has been made and explain what we believe this means for their individual claims.”
